If I wanted to start my own Trading card game buisness, would I have to get Licensed from wizards of thecoast?

I was told that they patented the Trading card game idea possibly however that doesnt make sense ot me since they don not control the industry (by far). However they are the beggest buisness. Would I really need to get a lisence from them to sell trading cards? Could I just not market it as a trading card Game?

Do something similar but vary it and give it a different name by doing it like this you are unlikely to need a license.
